Kim v Minister of Justice is in two parts. The first being a Judicial Review of the Minister of Justice decision to surrender Mr Kim to the People’s Republic of China.The second being a Discharge application under s 36 of the Extradition Act 1999.
Judicial Review was successful.
“The application to review the order to surrender Mr Kim is granted. The Minister is directed to reconsider whether Mr Kim is to be surrendered in light of this judgement…”

Discharge application under s 36 of the Extradition Act 1999 was unsuccessful. However “In light of the outcome of his discharge application Mr Kim may wish to again have an application for bail considered.”
