Miller & Carroll v New Zealand

For the first time, the Committee had held one oral hearing on a case” to provide additional information in a complex case before the United Nations Human Rights Committee. This was heard at the Office of the High Commissioner for Human Rights, Palais Wilson, Geneva on 31 October 2017. This is the fourth win before the Committe.

The Human Rights Committee, acting under article 5 (4), of the Optional Protocol to the Covenant, is of the view that the information before it discloses violations by the State party of article 9(1) and (4) and article 10(3) of the Covenant with respect to each author.
